THE CONCEPT, ESSENCE AND SIGNIFICANCE OF THE PENALTY MEASURES APPLICABLE TO THE JUVENILES SENTENCED TO IMPRISONMENT

The article is devoted to the study of various approaches understanding concept, content, essence, purpose and meaning penalty measures in legal science. Therefore, when studying this interdisciplinary category, author based on scientific opinions both Soviet modern Ukrainian researchers, formulated doctrines labor, administrative, criminal executive law, as well penitentiary psychology pedagogy. Thus, states that scholars (for example, M. V. Plyukhin, O. Belyaev, F. Pirozhkov, A. Shamis, I. Vodolaz, D. Shumlyaeva, Martyanov, Lukyanets, P. Khryapinskyi, Hrytenko, S. Mikhalko, Romanov, Z. Yaremko others) consider penalties a means punitive influence for non-compliance or violation norms; form implementation coercion method used committing disciplinary offense; negative consequence misconduct person who committed misdemeanor, certain adverse moral, material physical nature; manifestation assessment convict's behavior actions, which consists limiting convict’s rights, worsening conditions his abidance. In addition, number scholars, including Artamonov, L. Remenson, Yaremko, G. Kolb, Badyra T. Denysova others, sanctions not so much punishment but correction resocialization convicts, prevention new offenses whom it applied, other persons. Consequently, majority researchers recognize of, one hand, punitive, corrective influence, other, educational emphasizing simultaneously their stimulating character, encouraging convicted law-abiding behavior, thus contributes prisoners. reasonableness essence also confirmed by legislator's indication Criminal Executive Code Ukraine (Part 2 Article 1, 5, Part 4 5 123) precisely characteristic these measures. application juveniles sentenced imprisonment, first foremost, exercising such prisoners, which, them creates resocialization.
